Landlord told me that we are too loud and said we need to have everything shut down at 10pm, is that legal?

So i guess we are making too much noise and the landlord said that we need to stop making noise at 10pm, keep company to a minimal, when we are going up to our apartment we need to basically tip toe so we don’t make too much noise, i mean this is crazy because these apartments were built crappy, you can hear the neighbors snoring at night its really hard to keep it down with 2 kids and really thin walls. we have a 6 month lease and this is our 1st month,what should we do? can we get evicted?

Yes, you can get evicted if there are complaints about your noise. It can be a problem in many apartments but you do have to try to be fair. If you can hear other people’s noise, then obviously they can hear yours. Try to keep it down late at night.

    Depends what’s written in your lease, but in general, yes you can be evicted for something like that.

    take back your manoey for the rest 5 months, say to your landlord that you have a new job out of town or other family businesses to do

    If you create a nuisance that the Landlord can document, then you theoretically can get evicted. This is somewhat of a nuclear option for many landlords because its so expensive, time consuming and not guaranteed. Remember, the courts decide if you can be evicted based on the evidence, not your landlord.

    Additionally, if you are being disturbed by the neighbors (even because of crappy construction) , you need to make written complaints to the landlord. You have a right to peacefully enjoy your own home as well.

    Maybe not the advice you asked for but you probably should get out as soon as possible. Things will just get worse on both ends. Because of the noise you experience, you might be able to get out early. Just make sure you document everything. Or you can just wait it out and leave when your 6 months is up.

    There are likely noise ordinances in your area specific to 10pm. It would stand to reason they probably expire at either 6 or 8 am. These ordinances are enforceable by your local police.
